The 2 Types of Car Accident Claims in Michigan
When you get into a car accident in Michigan, you generally have two types of claims. The first type is what we call a first party claim. This is a claim against your own insurance company for medical bills, so any medical bills that were incurred after the accident that are related to the accident, they’ll pay for.
They’ll also pay for wage loss if you’ve missed any time from work after the accident. They’ll pay you for medical mileage if you’re driving to and from doctor’s offices related to the accident, any replacement services. And, if you need help around the house, they’ll pay somebody to help you around the house.
First party claims also cover tenant care. If you have personal needs like helping with bathing or showering or dressing, they’ll also pay somebody to do that.
The second type of claim is what we call a third-party claim. This is a claim against the at-fault driver, and we’re generally going after the at-fault driver’s insurance policy. This is a claim for pain and suffering and how your life changed after the accident.

Can I Work During an Active Car Accident Injury Insurance Claim?
This is a question we get all the time. “Can I work and still pursue an auto accident claim?”
Absolutely, yes. Most people have bills, they have dependents. They have people that are relying on them for money to survive. You can’t stop your life.
A car accident case may take up to three years from the accident date. This means for up to three years the insurance company will not pay you until the case is settled. What Happens if the At Fault Driver Has No Insurance?
What happens in a case when the at-fault driver has no insurance? You may still have a case. If you purchase uninsured or underinsured motorist coverage, you may still be able to collect for that benefit. In that case, your own insurance company will cover you or they claim you would have made against the at-fault driver.
They will pay out just like the at fault driver would have if you had insurance. This is a very good benefit to have. Please make sure you purchase uninsured and underinsured motorist coverage as part of your own insurance policy. Another example. Let’s say you’re rear-ended by a car that only had $50,000 in insurance coverage, but your own insurance policy has $250,000 in underinsured motorist coverage. You can now collect an extra $200,000 from your own insurance company just by having that benefit on your policy.
